Energy Performance Certificate (EPC) Requirements

As of April 2018, all privately rented properties are mandated to achieve a minimum energy performance rating of ‘E’ on their Energy Performance Certificate (EPC). Landlords are restricted from entering into new tenancy agreements unless the property meets or exceeds this ‘E’ rating, unless a valid exemption applies. Failure to comply may result in civil penalties of up to £5000 for breaches.

This requirement may pose significant challenges as many privately rented homes tend to be older and are often more difficult to make energy efficient. In fact, approximately half a million homes in the UK currently fall short of meeting these energy efficiency standards.

Since April 2016, private residential landlords cannot unreasonably refuse a tenant’s request for energy efficiency improvements if the property is rated ‘F’ or ‘G’, although they may not necessarily bear the cost at this stage. ECO4 Funding may offer assistance, subject to a survey and the condition of the property.

Starting from April 1st, 2020, all domestic properties with existing tenancies must achieve an EPC rating above ‘E’ or have a valid exemption. Non-domestic properties must adhere to the Minimum Energy Efficiency Standards (MEES) by April 2023. These deadlines approach swiftly, just as the 2018 deadline did. Therefore, when carrying out property improvements, it’s crucial to consider the property’s energy performance. Furthermore, the government has outlined plans to raise standards further, aiming for a band ‘D’ rating by 2025 and a band ‘C’ rating by 2030.
